New York State Pay Transparency Law goes into effect Sept. 17, 2023.
What are the requirements under this Law?
Covered employers are to disclose salaries, wages, or their ranges for advertised jobs, promotions, or transfer opportunities and use good faith in reporting the salaries, wages, or their ranges. Employers should also explicitly post in writing if the position is based on commission.
Who are covered employers?
Employers who have four or more employees in New York State, as well as out-of-state; or employers who employ four or more employees out-of-state who report to an in-state employer.
How can you ensure your business is in compliance?
- Review/assess compensation policies;
- Determine pay ranges for all positions;
- Modify current job advertisements as needed
- Train Hiring Managers on the disclosure requirements; and
- Conduct a pay equity audit to ensure that there are no significant salary discrepancies.
